Términos del Servicio

Estos Términos rigen el uso del sitio segurosmarketing.com y del portal InsureMarket (el "Servicio"), operado por [RAZÓN SOCIAL] ("InsureMarket", "nosotros"). Al crear una cuenta o usar el Servicio, aceptas estos Términos.

1. Descripción del Servicio

InsureMarket es una plataforma de CRM y marketing para agencias y agentes de seguros: gestión de contactos y pólizas, referidos, campañas de Email/SMS/WhatsApp, páginas web, y generación y publicación de contenido en redes sociales. InsureMarket no es una aseguradora ni un agente de seguros, y no vende pólizas.

2. Cuentas y elegibilidad

Debes ser mayor de 18 años y proporcionar información veraz. Eres responsable de mantener la confidencialidad de tu contraseña y de toda actividad en tu cuenta.

3. Suscripciones, prueba gratis y pagos

  • Los planes se cobran por mes en USD. El plan y su precio se muestran al suscribirte.
  • Ofrecemos una prueba gratuita de 7 días. Se requiere una tarjeta válida para iniciarla.
  • Si no cancelas antes de que terminen los 7 días, se cobra automáticamente el primer periodo, y luego se renueva cada mes en la misma fecha.
  • Puedes cancelar en cualquier momento desde el portal; la cancelación evita cobros futuros. Salvo que la ley exija lo contrario, los pagos ya realizados no son reembolsables.
  • Los pagos se procesan por Stripe.

4. Créditos de IA y de envío

Ciertas funciones (generación con IA, publicación en redes y envío de campañas) consumen "créditos". Tu plan incluye una cantidad de créditos por periodo y puedes comprar paquetes adicionales. Los créditos se destinan al uso del Servicio, no son transferibles ni canjeables por dinero, y salvo que la ley exija lo contrario no son reembolsables.

5. Uso aceptable y cumplimiento

Al usar el Servicio te comprometes a:

  • Enviar mensajes únicamente a contactos que te han dado su consentimiento, cumpliendo leyes como TCPA, CAN-SPAM y las políticas de los operadores y de WhatsApp.
  • Honrar las bajas (STOP / cancelar suscripción) sin demora.
  • No enviar spam, contenido ilegal, engañoso, difamatorio o que infrinja derechos de terceros.
  • Cumplir las reglas de las plataformas de redes sociales que conectes.

Eres el único responsable de tus contactos, del consentimiento y del contenido que envías o publicas.

6. Tu contenido

Conservas la titularidad del contenido y los datos que cargas. Nos concedes una licencia limitada para alojar y procesar dicho contenido con el único fin de operar el Servicio para ti (por ejemplo, enviar tus campañas o publicar tus posts).

7. Integraciones de terceros

El Servicio se integra con proveedores como Stripe, Twilio, Resend, Supabase, Netlify, OpenAI, Anthropic, Meta, TikTok y X. Tu uso de esas integraciones también está sujeto a sus términos. No somos responsables por fallos o cambios en servicios de terceros.

8. Propiedad intelectual

El software, la marca y el diseño de InsureMarket son de nuestra propiedad. No puedes copiarlos, revenderlos ni realizar ingeniería inversa salvo lo permitido por la ley.

9. Descargos de responsabilidad

El Servicio se ofrece "tal cual", sin garantías de disponibilidad ininterrumpida ni de resultados comerciales. InsureMarket no brinda asesoría legal, fiscal ni de seguros.

10. Limitación de responsabilidad

En la máxima medida permitida por la ley, InsureMarket no será responsable por daños indirectos, incidentales o consecuentes, ni por lucro cesante. Nuestra responsabilidad total se limita a lo que hayas pagado por el Servicio en los 12 meses previos.

11. Indemnización

Aceptas indemnizar a InsureMarket frente a reclamaciones derivadas de tu uso del Servicio, de tu contenido, o del incumplimiento de estos Términos o de la ley (incluyendo el envío de mensajes sin consentimiento).

12. Terminación

Puedes cancelar cuando quieras. Podemos suspender o cerrar cuentas que incumplan estos Términos o la ley. Al terminar, cesa tu derecho a usar el Servicio.

13. Ley aplicable y cambios

Estos Términos se rigen por las leyes del estado de Florida, EE. UU., sin perjuicio de normas imperativas de tu jurisdicción. Podemos actualizar estos Términos; publicaremos la versión vigente con su fecha.

Terms of Service

These Terms govern use of segurosmarketing.com and the InsureMarket portal (the "Service"), operated by [LEGAL ENTITY NAME] ("InsureMarket", "we"). By creating an account or using the Service, you accept these Terms.

1. Description of the Service

InsureMarket is a CRM and marketing platform for insurance agencies and agents: contact and policy management, referrals, Email/SMS/WhatsApp campaigns, websites, and social media content generation and publishing. InsureMarket is not an insurer or insurance agent and does not sell policies.

2. Accounts and eligibility

You must be 18 or older and provide truthful information. You are responsible for keeping your password confidential and for all activity on your account.

3. Subscriptions, free trial and payments

  • Plans are billed monthly in USD. The plan and price are shown at signup.
  • We offer a 7-day free trial. A valid card is required to start it.
  • If you do not cancel before the 7 days end, the first period is charged automatically, and it renews monthly on the same date.
  • You can cancel anytime from the portal; cancellation prevents future charges. Except where required by law, payments already made are non-refundable.
  • Payments are processed by Stripe.

4. AI and sending credits

Certain features (AI generation, social publishing and sending campaigns) consume "credits". Your plan includes an amount of credits per period and you may buy additional packs. Credits are for use of the Service, are non-transferable, not redeemable for cash, and except where required by law are non-refundable.

5. Acceptable use and compliance

By using the Service you agree to:

  • Message only contacts who have given you consent, complying with laws such as TCPA, CAN-SPAM and carrier and WhatsApp policies.
  • Honor opt-outs (STOP / unsubscribe) promptly.
  • Not send spam or illegal, deceptive, defamatory or infringing content.
  • Comply with the rules of any social platforms you connect.

You are solely responsible for your contacts, their consent, and the content you send or publish.

6. Your content

You retain ownership of the content and data you upload. You grant us a limited license to host and process that content solely to operate the Service for you (for example, to send your campaigns or publish your posts).

7. Third-party integrations

The Service integrates with providers such as Stripe, Twilio, Resend, Supabase, Netlify, OpenAI, Anthropic, Meta, TikTok and X. Your use of those integrations is also subject to their terms. We are not responsible for failures or changes in third-party services.

8. Intellectual property

The InsureMarket software, brand and design are our property. You may not copy, resell or reverse-engineer them except as permitted by law.

9. Disclaimers

The Service is provided "as is", without warranties of uninterrupted availability or of business results. InsureMarket does not provide legal, tax or insurance advice.

10. Limitation of liability

To the maximum extent permitted by law, InsureMarket will not be liable for indirect, incidental or consequential damages, or lost profits. Our total liability is limited to the amount you paid for the Service in the prior 12 months.

11. Indemnification

You agree to indemnify InsureMarket against claims arising from your use of the Service, your content, or your breach of these Terms or the law (including sending messages without consent).

12. Termination

You may cancel anytime. We may suspend or close accounts that breach these Terms or the law. On termination, your right to use the Service ends.

13. Governing law and changes

These Terms are governed by the laws of the State of Florida, USA, without prejudice to mandatory rules of your jurisdiction. We may update these Terms; we will post the current version with its date.
